Petitioner Conrado Vela, a prisoner in the Texas Department of Corrections, appeals from the district courts denial of his petition for a writ of habeas corpus alleging ineffective assistance of counsel. We conclude that Velas counsel at his sentencing proceeding was constitutionally deficient, and that counsels errors resulted in actual and substantial disadvantage to his clients defense. Accordingly, we reverse the district courts judgment and remand with instructions to grant the writ unless the State elects within a reasonable time to retry Vela.
